Terms of Service

Last Updated: July 12, 2026

Welcome to BrinksGlobal. By accessing our website, utilizing our digital platforms, or engaging our freight forwarding, customs brokerage, and supply chain services, you ("Customer") agree to be bound by the following Terms of Service. Please read them carefully.

1. Scope of Services

BrinksGlobal acts as a non-vessel operating common carrier (NVOCC), freight forwarder, and customs broker. We arrange for the transportation, storage, and clearance of goods. Unless explicitly stated in a separate written contract, we act as an agent for the Customer in arranging services with third-party carriers, and we are not the actual carrier of the goods.

2. Customer Obligations & Compliance

The Customer warrants and agrees to:

  • Provide accurate, complete, and timely information regarding the cargo, including weight, dimensions, and accurate Harmonized System (HS) classification codes.
  • Strictly comply with all applicable international, national, and local laws, including export controls, economic sanctions, and anti-bribery regulations.
  • Properly declare any Dangerous Goods (DG) in accordance with IATA, IMDG, or ADR regulations, providing all necessary Material Safety Data Sheets (MSDS).
  • Ensure all cargo is adequately packed, marked, and labeled for international transit.

3. Rates, Invoicing, and Payment

Quoted rates are subject to availability and may be adjusted based on fluctuations in carrier surcharges (e.g., BAF, CAF), currency exchange rates, or changes in customs duties. Invoices are payable within the terms specified (typically 30 days). BrinksGlobal reserves the right to exercise a general lien on any cargo in our possession for any outstanding charges owed by the Customer.

4. Limitation of Liability

To the maximum extent permitted by law, BrinksGlobal's liability for loss, damage, or delay to cargo is strictly limited in accordance with applicable international conventions (including the Hague-Visby Rules for ocean freight and the Montreal Convention for air freight), or our standard trading conditions, whichever is lower. We strongly recommend that Customers procure their own comprehensive cargo insurance, as our liability limits may not cover the full value of the goods.

5. Force Majeure

BrinksGlobal shall not be held liable for any delay or failure in performance resulting from acts beyond our reasonable control, including but not limited to acts of God, severe weather, pandemics, port congestion, labor strikes, war, terrorism, or government embargoes.

6. Indemnification

The Customer agrees to indemnify, defend, and hold harmless BrinksGlobal, its officers, directors, and employees from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of the Customer's breach of these Terms, inaccurate cargo declarations, or violation of any applicable laws.

7. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which our Global HQ is located. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of that jurisdiction, unless otherwise agreed in writing.
